When politically-charged issues are brought before the courts for immediate action - either to block enforcement or otherwise adjudicate controversial questions - judges are thrust into a political firestorm. Similarly, when judges or the judicial system are subjected to political attack, judges must juggle their right of free speech with their ethical responsibility to preserve public trust and confidence in the courts. This program will explore the dynamics of this modern judicial dilemma against the backdrop of the Model Code of Judicial Conduct.
