This CLE will cover two recent federal agency initiatives that take aim at hiring practices and worker conduct rules that many employers have relied on for decades.

Tom Williams will provide an overview of the recent decision in Purple Communications, where the NLRB laid down new rules that require employers to permit workers to use company email systems for union organizing efforts and other concerted activity that is protected by Section 7 of the National Labor Relations Act.

Joe Bilby’s presentation will discuss the EEOC’s nationwide effort to pursue discrimination lawsuits against employers that use criminal background checks to screen job applicants, relying on the theory that such practices are unlawful because they have a “disparate impact” on certain minorities.
