For the next 20 years, an average of 10,000 people will turn 65 years old each day. As a natural byproduct of an aging population, attorneys will be dealing with a growing number of clients who have diminished capacity due to their advanced years or conditions such as dementia. This will be true no matter what the area of practice. As a result, we have to know our ethical obligations to these clients and how to deal with family members, powers of attorney, or guardians that might be representing the client. From identifying the client to making sure that no conflicts exist to understanding what type of relationship you must maintain even with an impaired client, our ethical obligations only intensify when dealing with this population.
