Recusing and Reporting Judges: The Legal, Ethical and Practical Dimensions
Determining whether a particular judge is disqualified to preside over a specific case is a lawyer’s responsibility that cannot be disregarded. What are the statutory, ethical and constitutional grounds for disqualifying a judge? How should an attorney investigate whether a particular judge may be disqualified in counsel’s case? What are the various mechanisms for moving to disqualify a judge? What are the ethical obligations of an attorney faced with a judicial disqualification issue? What type of judicial conduct should be reported to the Kentucky Judicial Conduct Commission? Who should report a judge’s misconduct? When should a judge’s conduct be reported to the Commission?
