U.S./Canada Cross-Border Litigation:
Key Considerations for U.S. Lawyers

Where to commence litigation; jurisdictional considerations; enforcement of U.S. judgments and arbitral awards in Canada; the loser pays system for legal fees/costs; limitation periods in Canada; appellate options; obtaining injunctions: prohibitive and Mareva; the unique power of Anton Piller orders; enforcement of letters rogatory/letters of request to obtain evidence in Canada for use in U.S. litigation; service of process in Canada; Canada's Corruption of Foreign Public Officials Act (CFPOA); working with Canadian counsel: fee arrangements.
